This privacy statement discloses the privacy practices for Service Provider.

We want to build your trust and confidence in the Internet by promoting the use of fair information practices. We are committed to your privacy and are disclosing our information practices in this company statement.

This Privacy Policy lets you know how your personal information is processed and used. We promise that we will take steps to use your personal information only in ways that are compatible with this Privacy Policy. The following policies are only in effect for the Web pages, Applications, Mobile applications (or Apps) , newsletters, discussion lists and opt-in announcement lists owned and operated by Service Provider.

Information Request

We may also request your e-mail address or mailing address for the purposes of conducting a survey or to provide additional services (for example, subscriptions to e-mail newsletters, announcement lists or information about seminars) Whenever we request the identity of a visitor, we will clearly indicate the purpose of the inquiry before the information is requested. We maintain a strict “No-Spam” policy that means that we do not intend to sell, rent, or otherwise give your e-mail address to a third-party, without your consent.

When you use our services, we process the Service Data as instructed by you. We perform analytics on those data to (i) assess needs of your business to determine or suggest suitable Service(s); (ii) send you requested information about the Service(s); (iii) respond to customer service requests, questions and concerns; and (iv) for product improvement purposes.

Whenever you link your email with Kit19 manually in order to read and/or write mails to your contacts from within Kit19, we collect information you filled in the fields From, To, CC, Subject, Thread ID, Message ID and Label ID. We will create a copy of the email thread in the inbox of all your team members. If any team member access is revoked by you, we will delete the created email from the corresponding team member's inbox. We will never delete the original email which was linked to Kit19 originally.

In order to enhance productivity, you may want to connect your gmail account with Kit19 to be able to view and send mails from within our application using your gmail account. If you connect your Gmail account with Kit19, we shall some information required to fetch and send mails on your behalf. This information is strictly used only for this purpose. If you wish to remove or disconnect your gmail account from Kit19, all the information reagrding connecting your gmail account, the copies of incoming and outgoing mails stored (if any) will be deleted permanently from our application. We do not delete any mails from your original gmail account.

Kit19`s use and transfer to any other app of information received from Google APIs will adhere to Google API Services User Data Policy, including the Limited Use requirements.

In addition, Service Provider will not send you email that you have not agreed to receive. We may from time to time send e-mail announcing new Service Provider products and services. If you choose to supply your postal address in an online form, you may receive mailings from other reputable, third-party companies.

If you choose to purchase something online, we need to know your name, e-mail address, mailing address, credit card number, and expiration date. This allows us to process and fulfill your order and to notify you of your order status. This information may also be used by us to notify you of related product and services, but will not be shared or sold to third parties for any purpose.

Kit19 provides various integrations to thirty party APIs and resources and services (collectively referred to as resources) to provide you a unified platform for business functions. Most of these resources are available to users through their user accounts with the third party vendor and the use of these resources is subject to your agreeing and abiding by the Terms of the respective service provider. As such, Kit19 has no control over the performance and activation or deactivation of these resources whether caused by your actions or otherwise. Kit19 specifically disclaims any responsibility of the performance or continuity of these resources and the user must deal with the third party vendors at his own capacity

Additional Terms for usage of whatsapp API:

Kit19 provides Whatsapp Business API integration within its platform to its users for better experience. However, Whatsapp API, being a product of facebook, is governed by the Terms and Conditions defined by facebook for its usage. By applying for WhatsApp business API through Kit19 and using the API, the user must agree to the Terms of its use and follow the Best Practices prescribed for the same. To use this API, businesses must complete a series of requirements, including, but not limited to: a. Following WhatsApp's legal policies, including the WhatsApp Commerce Policy and the WhatsApp Business Policy. b.Going through Business Verification. c. Following our Display Name Guidelines. The user is advised to check any updates in relation to the usage of the API from facebook's website directly. The charges for the API are prepaid and non refundable. Hence, it is strongly recommended to follow Whatsapp APIs guidelines strictly. Kit19 has no control over facebook's rejecting, blocking or limiting or discontinuing your whatsapp API account due to any reason. Users must follow due diligence while using the service.

Additional Information access through Mobile application

Kit19 provides Kit19 app as a free app for subscribers. This SERVICE is provided by Kit19 at no cost to the web subscribers of Kit19 and is intended for use as is. You may find and our app on Google playstore here and on app store here

For Mobile applications, we require certain additional permissions for the app to work properly. In absence of these permissions, the app's functionality will be limited. These permissions include the permission to access Camera, Microphone device (both wired and wireless), device storage, call logs, SMS and Email and device location. Additionally, the app collects and stores images, documents and files that you upload for anytime, anywhere access. When you choose to allow it, our mobile applications have access to the camera, microphone, call history, contact information, photo library, files and other information stored on your mobile device. Our applications require such access to provide their services properly. These files and assets are not shared or used anywhere other than their required purpose.

If you/your company is using our mobile applications for field force management, we require the permissions to access your device location. This permission is based on your consent and can be turned on/off from the app by toggling the "On-field" value from Menu > Settings. Your location is tracked in foreground and background when this value is turned on. We don't access your location once you turn this value off. When you choose to provide access, location-based information is also collected for purposes including, but not limited to, locating nearby contacts or setting location-based reminders. This information will be exclusively shared with our mapping providers and will be used only for mapping user locations. You may disable the mobile applications' access to this information at any time by editing the settings on your mobile device. The data stored on your mobile device and their location information to which the mobile applications have access will be used in the context of the mobile application, and transferred to and associated with your account in the corresponding services (in which case the data will be stored on our servers) or products (in which case the data will remain with you unless you share it with us)

Log Data

We want to inform you that whenever you use our Service, in a case of an error in the app we collect data and information (through third party products) on your phone called Log Data. This Log Data may include information such as your device Internet Protocol (“IP”) address, device name, operating system version, the configuration of the app when utilizing our Service, the time and date of your use of the Service, and other statistics.

Cookies

Cookies are files with a small amount of data that are commonly used as anonymous unique identifiers. These are sent to your browser from the websites that you visit and are stored on your device's internal memory.

This Service does not use these “cookies” explicitly. However, the app may use third party code and libraries that use “cookies” to collect information and improve their services. You have the option to either accept or refuse these cookies and know when a cookie is being sent to your device. If you choose to refuse our cookies, you may not be able to use some portions of this Service.

2. Protect and defend the rights or property of Service Provider, or visitors to Service Provider
3. Identify persons who may be violating the law, the legal notice, or the rights of third parties,
4. Cooperate with the investigations of purported unlawful activities. Service Provider uses reasonable precautions to keep the information disclosed to us secure. However, we are not responsible for any breach of security or for any actions of any third parties which receive the information. Service Provider also links to a wide variety of other sites and contains advertisements of third parties. We are not responsible for their privacy policies or how they treat information about their users.

Sharing Information

We may partner with another party to provide specific services. When the user signs up for these services, we will share names, or other contact information that is necessary for the third party to provide these services. If you do not want your personal information shared, please email contactus@kit19.com with your request.

Security

We value your trust in providing us your Personal Information, thus we are striving to use commercially acceptable means of protecting it. But remember that no method of transmission over the internet, or method of electronic storage is 100% secure and reliable, and we cannot guarantee its absolute security.

Children’s Privacy

These Services do not address anyone under the age of 13. We do not knowingly collect personally identifiable information from children under 13. In the case we discover that a child under 13 has provided us with personal information, we immediately delete this from our servers. If you are a parent or guardian and you are aware that your child has provided us with personal information, please contact us so that we will be able to do necessary actions.

Changes to This Privacy Policy

We may update our Privacy Policy from time to time. Thus, you are advised to review this page periodically for any changes. We will notify you of any changes by posting the new Privacy Policy on this page.

Your Consent To This Agreement

By using our Web site, you consent to the collection and use of information by Service Provider as specified above. If we decide to change our privacy policy, we will post those changes on this page so that you are always aware of what information we collect, how we use it, and under what circumstances we disclose it. Please note that messages will be charged on submission basis. SMS are purchased on prepaid basis, hence all purchases are non refundable. If you face any problem, do write to us at contactus@kit19.com and we shall try our best to resolve it at the earliest. In case of all disputes, the place of jurisdiction will be New Delhi.

The software service and all related components and information is on an "As is" and "As Available" basis without any warranties of any kind, express or implied, and hereby disclaims all implied warranties, including any warranty of merchantability and warranty of fitness for a particular purpose.

WARNING : If you intend to send SMS through our application(s) to Indian mobiles, please register with DLT, if not already done. Regulations of sending SMS to Indian mobiles are governed by TRAI that defines policies that you must abide by, in order to send SMS through web applications. These policies are updated from time to time. It is your responsibility to be up to date about these policies and to make sure that you are eligible to send SMS. Any violation of these regulations may lead to deactivation of account & no refund will be issued in such cases. If you violate these regulations that result in an imposition of a penalty as per TRAI, you shall be liable to bear all the penalties so imposed.

We reserve the right to terminate your account with immediate effect without any liability if your account is found to violate the TRAI regulations set out for the usage of SMS. TRAI updates these regulations on http://nccptrai.gov.in. We recommend going through these regulations in order to ensure abiding by the regulations set out.
